Abstract

The study is devoted to determining the role and place of the principle of specialization of courts and judges in the judicial system and judicial proceedings of the EAEU member states, a number of which are undergoing reforms in this area. The topic chosen by the author is actualized in the context of globalization and intensified activation of measures to increase the competitiveness of all countries in the international arena, as well as the implementation of institutional reforms to ensure the rule of law, in particular in Kazakhstan.

The purpose of the article is to study the judicial system and judicial proceedings of the EAEU countries, organized and functioning in the post-Soviet space on the principle of judicial specialization, in compliance with continuity and gradual development in law and the state. The realization of this goal has determined the importance of solving the following tasks: 1) identification of the main factors that caused the appearance of previously unknown specialized courts in the EAEU member states; 2) identification of the presence of borrowings and differences in the judicial system and judicial proceedings of these countries; 3) conducting a comparative legal analysis of legislation and law enforcement practice in the judicial systems of these countries.

The methodological basis of the research was made up of general logical, theoretical, empirical, special legal methods of cognition (historical and legal, legal modeling, comparative jurisprudence).

The work uses an extensive database of existing regulatory legal acts of Armenia, Belarus, Kazakhstan, Kyrgyzstan and Russia concerning issues of judicial power, judicial system and judicial proceedings. The conceptual, declarative and programmatic documents on the reform and development of the judicial systems of the listed countries are considered. The opinions of legal scholars whose scientific works are devoted to issues of judicial specialization are analyzed.
