Abstract

The article sets and solves the problem of identifying and substantiating the historical and legal prerequisites for strengthening the state unity of the Russian Empire. With the help of the formal legal method, the norms of such legal monuments as the Law Books of 1497 and 1550, as well as the Cathedral Code of 1649, are analyzed. Using the historical and comparative method, the development of domestic law at different stages was compared, which allowed us to draw conclusions about the role of law in ensuring state unity. It is proved that the state unity was formed gradually, as the legal regulation of public relations strengthened. It is emphasized that the entire course of Russia's historical development has led to the emergence of a single state as a certain guarantee against external and internal threats. Already in the pre-imperial period, there was a consistent desire for systematization in the field of law, to create a single source of law for the whole country, a comprehensive legislative act. As a result, a single legal space was formed as an important condition for maintaining state unity. The ongoing expansion of the territory of the state required uniformity of legal regulation and its unification. On the eve of the proclamation of Russia as an empire, a new level of awareness of the role of law in the state is noted, in which law merges with state power and turns into a single political and legal phenomenon, simultaneously expressing both power itself and its legitimacy.
