Abstract

The article analyzes the process of evolution of existing approaches to understanding laws and legislation in Russian legal science.

The purpose of the study is to identify the features of the development of the theory of legislation at different stages.

In the course of the research, methods of synchronous and diachronic comparison were used, which made it possible to evaluate doctrinal approaches to understanding legislation in different periods. The method of analysis was used to study the works of scientists devoted to the methodology of jurisprudence.

As a result of the conducted research, it became possible to identify the peculiarities of understanding the essence of laws and the role of legislation in classical and post-non-classical doctrine. It is concluded that in post-non-classical jurisprudence, characteristic of postmodern society, legislation is considered in a broad context, in the problematic field of the general circle of social interaction, in interrelation and interdependence with various non-legal factors: social, political, economic, spiritual, ideological and psychological.
