The ratio of the categories “territory” and “space of law” is considered taking into account the mobility and instability of the borders of the latter. In the context of the expansion of the space of law caused by the development of modern technologies, the study of the potential opportunities and risks of such expansion for justice and law enforcement in general is of particular relevance. In this regard, the article discusses the limits of the use of digital technologies, including artificial intelligence, in the field of justice, and ways to neutralize the possible negative consequences of digitalization.
The purpose of the study is to identify the optimal practical forms and models of interaction between law and justice with the expanding space of new technologies. The task of the study is to identify and analyze the regularities of the influence of the process of expanding the space of law on the specifics of its application.
To achieve this goal, the author applied system-structural, historical-legal, comparative-legal and formal-legal methods.
Based on the results of the study, the author comes to the conclusion that currently, the space of law is not localized by the territory of the State. Its constant expansion poses new issues to judicial practice, including the emergence of new public relations and the need to apply flexible legal approaches to them (the analogy of law and law), which requires the participation of a law enforcement officer-a judge, and not artificial intelligence. At the same time, artificial intelligence can be used as a tool that does not replace a judge, but contributes to speeding up and simplifying legal proceedings, especially in terms of technical work. In addition, it is necessary to implement systematic measures aimed at further strengthening the uniformity of judicial practice, in particular, to establish the hierarchy and the legal nature of the explanations of the Supreme Court of Russia, as well as a uniform format of judicial acts of cassation instances.
