Abstract

The dignity of the individual is a multifaceted, polysemic concept that can be comprehended within the framework of the concept of legal polymorphism. Attempts to define the phenomenon of human dignity in law have led to the emergence of multiple, often opposite positions — from complete denial to understanding the dignity of the individual as the main principle determining the construction of the entire system of human and civil rights and freedoms. The constitutional reforms of 2020, which have a pronounced social orientation, actualize an additional scientific assessment of the category “dignity of the individual”.

The methodological apparatus consisted of general and special methods of scientific cognition: the method of special-legal research, comparative-legal, formal-logical, system-structural methods, etc.

The article focuses on the variability of approaches to the definition of the concept of “dignity of the individual”: an analysis of its constitutional and legal content and features manifested in the spectrum of sectoral regulation when applied in international law is carried out; theoretical approaches developed by legal science are considered. The category of “personal dignity” is considered in four aspects: as the main constitutional and legal principle; subjective law; legal institution; value and legal category.
