Abstract

Negotiations between representatives of the USSR, Great Britain, the USA and France in London in 1945 ended with the signing of an Agreement establishing an International Military Tribunal over the main war criminals. The organization, jurisdiction, functions and procedure of legal proceedings in the International Military Tribunal were defined in its Charter, which was included in the said Agreement as an integral annex. This act was based on the principles and norms of international law consistently accepted by the international community in terms of responsibility for aggressive war, the use of prohibited methods and means of warfare, as well as the commission of other international crimes. However, along with a detailed study by the legal community of the issues of the evolution of international criminal justice, insufficient attention in the legal literature is paid to the role of scientists of the Institute of Legislation and Comparative Law under the Government of the Russian Federation in its formation.

The article, using the methods of systematic and historical analysis, as well as the comparative legal method, confirms the conclusion about the fundamental nature of the results of scientific activity of scientists of the named Institute for the theory of international judicial processes.
