Abstract

The purpose of the article is to systematize, analyze and theoretically comprehend the activities of the Constitutional Court of the Russian Federation aimed at improving Russian legislation and including work on identifying, overcoming and preventing constitutionally significant defects in the current legislation.

Within the framework of these targets, tasks such as determining the criteria for the constitutional significance of the shortcomings of the current legislation (gaps, contradictions, uncertainties); systematization of constitutional principles used as legal criteria in the process of constitutional norm control; analysis of the experience of the Constitutional Court’s application of basic constitutional principles to assess the legal quality of legislation are set: identification of systemic problems of lawmaking that require increased attention from the legislator; determination and disclosure of the content of legal means used by the Constitutional Court to overcome constitutionally significant defects in legislation; formulation of proposals for optimizing lawmaking based on the experience of constitutional norm control.

The methodology of the research is based on traditional cognitive techniques and means of philosophical-legal, theoretical-legal and legal-dogmatic analysis of the issues under consideration.

Based on the results of the study, conclusions are drawn about the directions of further work to improve Russian legislation in line with a more complete consideration of social interests and constitutional standards of rulemaking formulated in the legal positions of the Constitutional Court. Special attention is paid to the importance of fruitful interaction between judges of the Constitutional Court, representatives of the legislative corps and the scientific and expert community of the country within the framework of the work highly demanded by society to strengthen guarantees of human and civil rights and freedoms in Russia. The effectiveness of such interaction is a guarantee of trust between the government and society.
