Abstract

The peculiarities of the modern institution of circumstances excluding the criminality of the act and the practice of its application were laid down by the criminal legislation of the Soviet period. Understanding the content of the norms formed by this criminal law institution, which have passed into the past, is possible primarily on the basis of documents reflecting the course of development and adoption of relevant acts, and assessments of contemporaries.

In this regard, the task of the study is to reveal the history of the adoption, content and some problems in the practice of applying the norms on necessary defense and extreme necessity of the RSFSR Criminal Code of 1926, based on the analysis of works published during the period of the Criminal Code 1926. In the article, the provisions on necessary defense and other situations of lawful harm contained in the Criminal Code of 1926 and in the theory of law were considered by the author in a system with other institutions of the Soviet criminal law, taking into account its class character.
