Abstract

The article assesses whether the part of the former Ukrainian Soviet Socialist Republic which after the Coup d’Etat in Kiev in 2014 is currently under control of president Zelensky still remains a sovereign State in the meaning of the UN Charter.

The research targets firstly the legal meaning of the notion “sovereign state” taking into account different opinions of the scholars regarding the area of application of the UN Charter principle of the sovereign equality: whether this principle is applicable only to independent states; or rather to all states including a state which is military and politically dependent on another state.

A wide range of methods is used so that to specify the difference between the notions “ a state” and “a sovereign state” and on such an academic basis to consider whether the Ukrainian Soviet Socialist Republic was a sovereign state in 1945 (when it became a UN Member) and whether Ukraine was such a state after 1991 (after dissolution of the USSR) and at last what is the current status of Ukraine after 2014 (the Coup d’Etat in Kiev).

As a result of the research it is suggested to disagree with the legal opinion according to which if a state is dependent on another state the first can not be qualified as a state. It is argued that even in this case of political and military dependency the first state is still a state. But it is not a sovereign state in the meaning of the UN Charter. The principle of sovereign equality is not applicable to such a state. In this context the relevant facts of US complicity in the Coup d’Etat in Kiev in 2014 are legally assessed along with the current military and political patronage of the US over Kiev and as a consequence it is concluded that the principle of sovereign equality is not applicable to Ukraine after the Coup d’Etat.
