Abstract

Currently, the issue of the nature and content of the administrative litigation is being updated, which has become a new area of research within the enlarged scientific specialty 5.1.2 “Public Law (state law) sciences”. So, the legal policy in the field of administrative litigation in its doctrinal and rule-making manifestations is of interest, which makes it possible to determine its structure and the main directions of development of the legislation regulating this process.

The purpose of the article is to identify the main views on the substantive content of the concept of “administrative litigation” and to study the legislation regulating the procedural activities of the judicial authorities for the consideration of cases arising in the field of public administration, in order to determine possible directions for its systematization based on the homogeneous nature of individual judicial proceedings.

Research methods: general scientific (analysis and synthesis, induction and deduction, systemstructural method) and methods of legal science (including formal legal method, method of literal, teleological and systematic interpretation of the norms of law).

Conclusion: legal policy in the field of administrative litigation in its doctrinal and law-making manifestations is able to ensure the development of approaches to structuring the types of judicial activity included in it and proposals for possible improvement of legislation. The disunity of the legislation regulating the administrative litigation, in a certain part, seems to be eliminated if there is political will and organizational efforts that can be undertaken by the legislator to develop relevant bills. The possibility of eliminating this disunity is determined by the presence of homogeneous proceedings regulated by different procedural legislation — on administrative proceedings and arbitration procedural legislation. At the same time, despite the absence in the Russiaт Constitution of an indication of judicial proceedings in cases of administrative offenses as an independent form of administration of justice, in the future it is hardly possible to legislate it as an integral part of administrative litigation.
