Abstract

Based on doctrinal approaches to the definition of criminal policy, the article analyzes current trends in improving criminal legislation.

The aim of the study is to develop theoretical provisions aimed at modernizing criminal policy within the framework of the mechanism for improving criminal legislation. In achieving this goal, special attention is paid to the analysis of current trends in criminalization; problems related to the definition of the object of crime and its impact on the structure of the Special Part of the Criminal Code of the Russian Federation; and the expansion of the practice of applying administrative prejudice and casual regulation in criminal law.

The dialectical method of cognition, general scientific methods of abstraction, analysis and synthesis, comparison and generalization, as well as special legal methods — comparative legal, logical-legal, etc. — are defined as the methodological basis of the study.

The article concludes that modern criminal policy should not be static. It should not take into account the prediction of real and prospective risks and threats to national security, including changes in the state, structure and dynamics of crime. It must respond qualitatively to the changes taking place, also through the improvement of criminal law norms.
